As reported in C4.5, Fiji's Constitutional Commission Chairman Professor Yash Ghai has confirmed what we already know. That Bainimarama’s so called Consitution review is nothing more than a scam to save himself, khaiyum and their parasitic relatives and followers, from prison.
In an interview with Radio Australia presenter, Campbell Cooney, Commission Chair Yash Ghai says that he is concerned about the whole process towards Fiji’s elections in 2014. Ghai says that he is concerned because the Bainimarama junta has stopped the Constitution Commission from examining existing decrees for possible incompatibility with their draft constitution. Ghai says that hundreds of illegal decrees have been past since the 2006 coup, which have:
Ghai also stated that a lot of these decrees need to be amended and in some cases repealed. This is not what Bainimarama and khaiyum want to hear. As reported previously in C4.5 and other blogs, the new Fiji constitution has already been drafted by Shameem, Gates and Khaiyum. We know this, so the Commission is only a stage show for the gullible and spineless international community and those unfortunate innocent people hoodwinked by bainimarama’s lies. Ghai states, following the amended Decree 64 introduced last week by the illegal junta to allow the removal of the provision for public consultation after the draft constitution is completed, that "Now that power has been taken away from us, and I do not see how Fiji is going to have a free and fair election unless these decrees are cleaned up. So that power has been taken away and it's extremely worrying”. Bainimaram and Khaiyum imprisoned Fiji’s last democratically elected Prime Minister, Mr Laisenia Qarase, for offences that Khaiyum’s PS Public Enterprise is also guilty of, including other illegal acts. This was staged to remove Mr Qarase from standing for elections. But Bainimarama and khaiyum don’t have the majority support of the people – and they know it. But they did pay the unscrupulous Lowry Institute of Australia to lie for them. Now Ratu Joni Madraiwiwi, as a Mr Qarase supporter and a high Chief of Fiji, unlike the “bokola” Bainimarama who orders his men to address him as ratu, is a potential threat. Some have suggested that Ratu Joni, and Ro Temumu Kepa are ideal leaders to rally the people of Fiji. If so, then Bainimarama and khaiyum have something to be truly afraid of. It will mean imprisonment for them both and their supporters. So they are busy pushing their false messages to the innocent people of Fiji through their promiscuous PS information Sharon Smith-Johns, and the heavily intimidated media who is subject to heavy penalties. Of the amended decree, Ghai says that the most important point is that it eliminates the period in the process where the draft would be placed before the people and they would have a few weeks to discuss and debate it before the Constituent Assembly (CA) meets. And the views of the people would be conveyed to the CA. But Ghai says, "That has been eliminated so that from the time the draft is prepared and the Constituent Assembly meets is now barely a week, and maybe not even a week. So there will be no opportunity for the people or indeed members of the Constituent Assembly to absorb the recommendations and think about them individually, in groups and organisations before the process of debate in the CA starts". "This for us is a very serious problem because we have been assuring people there will be a period of time for this kind of debate, and the Constituent Assembly members themselves will have an opportunity to study the document carefully before they begin to debate it. And that is a very serious lacuna in the process". Professor Ghai also admits the work of the Constitution is not independent. And says, "Yes I'm afraid that is quite true, there has been massive interference. Now I get emails from PM to do this or not to do that, and this is a kind of harassment. We've also been now told to publish any newspapers ads for which we pay, every single expense we have incurred since the beginning of July”. "Now while we greatly welcome transparency and indeed there's a provision in the decree for which I'm responsible, which commits the commission to account to the people a report of our processes and funding, as well as a very professional audit of our financials before we are formally wound up in December. And it's also a little bit puzzling that a government which is so wedded to secrecy should suddenly be converted to transparency." So what we are seeing here is how Bainimarama and khaiyum intend to implement their pre-drafted version of the constitution and falsely proclaim it as the version drafted from submissions by the people. First, Khaiyum, Shameem and Gates draft their illegal version of the Fiji constitution. This, according to sources, has already been done. Next the Constitution Commission of Professor Ghai was created to prepare a draft constitution based on submissions from the people. Next, Khaiyum prepares a new decree stopping the Commission from reviewing the illegal decrees and stops the people of Fiji from being able to discuss and debate the draft Ghai Commission Constitution before the Constituent Assembly meets. Then the Constituent Assembly, elected by Bainimarama, to safe guard bainimarama’s interests, will then have the final say on Fiji’s constitution. They will then present the pre-drafted constitution (drafted by Shameem, Gates and Khaiyum) to the illegal President claiming it is based on submissions by the people. The fact is that the Constituent Assembly is only there to submit the pre-drafted Constitution and to stop the draft by the Commission ever being revealed to the people. So the views of the people will be ignored. And the gullible and spineless international community will be taken in, hook line and sinker. If this does occur then the people of Fiji will begin their lifelong journey under a brutal and corrupt dictatorship, where the judiciary is manipulated by Khaiyum and the Fiji economy is at the mercy of the Chinese government, with high unemployment and increasing food prices. But this may not be Fiji’s destiny. There is still an underbelly of resistance and growing awareness of Bainimarama and khaiyum’s evil plans and deeds and of the growing Chinese influence in the country. The elections are key, but as Professor Ghai points out, his powers under the Constitution Commission have been taken away from them so he does not see how Fiji is going to have a free and fair election with all the illegal decrees.
